For the first time in Telangana, the State government invoked the Epidemic Diseases Act, 1897, which empowers senior officials to take measures necessary to contain the coronavirus outbreak. The invoking of the Act means all private and corporate hospitals in Telangana will now have to set aside ‘Covid-19 corners’ to screen suspected cases, as and when required by the senior health authorities.
In exercise of powers conferred under the Act, the government framed regulations called as ‘The Telangana Epidemic Diseases (Covid-19) Regulations, 2020’, which will come in force immediately and be valid for one year. The regulations empower authorities to initiate action under Section 188 of the IPC (80 of 1860) against persons who refuse to get isolated or comply with health officials’ advice.
In case the spread of Covid-19 is anticipated in a defined geographic area, the Collector of the district or the Municipal Commissioner of the concerned corporation can implement containment measures such as barring entry and exit of population from the containment area, closure of schools, offices, cinema halls, swimming pools, gyms, other public areas etc., and banning mass congregations and functions.
Passive surveillance of Covid-19 cases can be taken and ensure hospital isolation of all suspected cases and their contacts. They also have the authority to designate any government or private building as a quarantine facility. Staff of all government departments and organisations in areas where Covid-19 spread is anticipated would be at the disposal of the Collector or Municipal Commissioner. Those violating any provision of these regulations would be deemed to have committed an offence punishable under relevant sections.
Private and government hospitals have to record the travel history of the suspected Covid-19 persons apart from history of their contacts. The regulations make it mandatory for every asymptomatic person with a travel history to affected countries to remain under home quarantine for 14 days. Every symptomatic person with travel history to affected countries would be isolated in a hospital and tested. Private and government hospitals must ensure that information of all such cases is immediately sent to authorities concerned.
